These Terms and Conditions ("Terms") govern your use of the services provided by Packers and Movers Noida ("Company," "we," "our," or "us"). By engaging our services, you ("Customer," "you," or "your") agree to comply with and be bound by the following Terms. Please read them carefully before using our services. If you do not agree to these Terms, you should not use our services.

Definitions

Service

refers to any service provided by Packers and Movers Noida, including but not limited to packing, moving, storage, transportation, and related services.

Goods

refers to any personal or business items, belongings, or property that are being packed, moved, stored, or transported by us on your behalf.

Contract

refers to the agreement between you and Packers and Movers Noida for the provision of services.

Third-Party Services

refers to any services provided by third parties, including insurance, transportation, and storage, that may be arranged by Packers and Movers Noida as part of the Service.

Service Agreement

Quotations:

All quotations provided by Packers and Movers Noida are based on the information provided by you. The final charges may vary based on the actual volume of Goods, distance, services required, and any additional services requested by you. Quotations are valid for a specified period as mentioned in the quote.

Booking Confirmation:

Your booking is confirmed only after you accept the quotation provided and make the necessary advance payment as stipulated by Packers and Movers Noida. We reserve the right to refuse or cancel any booking at our discretion.

Service Changes:

Any changes to the agreed-upon services, such as additional Goods, changes in destination, or special requests, must be communicated to us in advance. Additional charges may apply for such changes.

Cancellation Policy:

If you wish to cancel or reschedule the Service, you must provide us with at least [insert notice period, e.g., 48 hours] notice. Cancellations made with less notice may incur a cancellation fee, as specified in your Contract.

Customer Obligations

Accurate Information:

You agree to provide accurate and complete information regarding the Goods, including the nature, value, quantity, and any special handling requirements. Packers and Movers Noida will not be responsible for any issues arising from inaccurate or incomplete information.

Packing:

You may choose to pack the Goods yourself or request our professional packing services. If you choose to pack the Goods, you must ensure they are securely packed to prevent damage during transportation. Packers and Movers Noida will not be liable for any damage to Goods packed by you.

Prohibited Items:

You agree not to include any hazardous, illegal, perishable, or otherwise prohibited items in the Goods. Packers and Movers Noida reserves the right to refuse to pack, move, or store any items deemed unsafe or unsuitable.

Accessibility:

You must ensure that the pick-up and drop-off locations are accessible for our vehicles and staff. Any delays or additional costs incurred due to lack of accessibility will be your responsibility.

Insurance:

You are responsible for obtaining adequate insurance coverage for the Goods during packing, moving, storage, and transportation. Packers and Movers Noida may offer or facilitate insurance options, but the decision to purchase insurance remains solely with you.

Liability and Limitations

Liability for Damage:

Packers and Movers Noida takes every precaution to ensure the safe handling and transportation of your Goods. However, we are not liable for any damage, loss, or deterioration of Goods unless caused by our gross negligence or willful misconduct.

Limitation of Liability:

Our liability for any loss or damage to Goods is limited to the lesser of the actual cost of the Goods or the amount specified in your Contract. We are not liable for any indirect, consequential, or incidental damages arising from the Service.

Claims:

Any claims for loss or damage must be submitted in writing within [insert time period, e.g., 7 days] of the completion of the Service. Failure to notify us within this period may result in the denial of the claim.

Third-Party Liability:

Packers and Movers Noida is not responsible for any loss or damage caused by third-party services, including transportation, storage, or insurance providers. Any claims related to third-party services should be directed to the respective provider.

Payment Terms

Payment Schedule:

Payments are due as per the schedule specified in your Contract. This may include an advance payment, payment upon completion, or other agreed-upon terms. Failure to make timely payments may result in the suspension or cancellation of the Service.

Additional Charges:

Any additional services requested by you or any unforeseen circumstances that result in additional costs will be invoiced separately. You agree to pay these additional charges within [insert time period, e.g., 7 days] of receiving the invoice.

Late Payments:

Late payments may incur interest charges at the rate specified in your Contract. Packers and Movers Noida reserves the right to withhold the delivery of Goods or take other legal action in the event of non-payment.

Refunds:

Refunds for cancellations or overpayments will be processed as per our cancellation policy and only after any applicable cancellation fees have been deducted.

Storage Services

Storage Agreement:

If you engage Packers and Movers Noida for storage services, a separate storage agreement will be provided. This agreement will outline the terms of storage, including rental fees, duration, and access to Goods.

Access to Storage:

You may access your stored Goods during the specified hours of operation, subject to prior notice. Access outside of these hours may incur additional charges.

Termination of Storage:

Either party may terminate the storage agreement with prior notice as specified in the storage agreement. You must remove all stored Goods before the termination date. Failure to do so may result in additional charges or the disposal of the Goods.

Termination of Service

Mutual Termination:

Either party may terminate the Service agreement by providing written notice to the other party, subject to the terms of the cancellation policy.

Termination by Packers and Movers Noida:

We reserve the right to terminate the Service agreement at any time for reasons including but not limited to non-payment, violation of these Terms, or unsafe conditions.

Effect of Termination:

Upon termination, you are responsible for any outstanding payments and the removal of Goods from our possession. Packers and Movers Noida may retain possession of the Goods until all payments are made.

Indemnification

Customer Indemnity:

You agree to indemnify, defend, and hold harmless Packers and Movers Noida, its employees, agents, and affiliates from any claims, liabilities, damages, or expenses arising from your breach of these Terms, including any damage to property or injury to persons caused by your Goods.

Force Majeure

Force Majeure Events:

Packers and Movers Noida shall not be liable for any delay, failure, or interruption in the performance of the Service due to events beyond our reasonable control, including but not limited to natural disasters, strikes, accidents, or governmental actions.

Dispute Resolution

Governing Law:

These Terms and any disputes arising from the Service shall be governed by and construed in accordance with the laws of India.

Dispute Resolution:

Any disputes arising out of or in connection with these Terms shall be resolved through negotiation between the parties. If the dispute cannot be resolved amicably, it shall be referred to arbitration in accordance with the [insert applicable arbitration rules] of India. The arbitration shall take place in Noida, and the decision of the arbitrator shall be final and binding.

Amendments

Changes to Terms:

Packers and Movers Noida reserves the right to amend these Terms at any time. Any changes will be communicated to you in writing and will take effect from the date of communication. Continued use of our services after the amendment constitutes your acceptance of the revised Terms.

Miscellaneous

Severability:

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Waiver:*

The failure of either party to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

Entire Agreement:

These Terms, together with the Contract and any additional agreements, constitute the entire agreement between you and Packers and Movers Noida regarding the Service and supersede any prior agreements or understandings.
